Terms of Service

The terms that govern your use of ZapVid

Introduction

These Terms of Service ("Terms") govern your use of ZapVid (the "Service"), available at zapvid.ai. By creating an account, uploading a photo, buying credits, or subscribing to a plan, you agree to these Terms.

What the Service Does

ZapVid generates short videos from a photo you upload, placing your subject in scenes inspired by popular online trends. All output is created by artificial intelligence and may contain visual errors.

Acceptable Use

You may only upload photos of:

  • yourself,
  • your own pets, or
  • adults who have given you clear permission to use their photo for this purpose.

Before you upload a photo of anyone other than yourself, you must get that person's permission to upload their photo and to make an AI video of them. This applies to every recognizable person in the photo, including the friends you add to the scene. Do not upload photos of celebrities or public figures unless you have their permission.

You must not use the Service to:

  • upload a photo of any person without their consent,
  • create sexual, nude, or sexually suggestive content of anyone,
  • create any content involving a person under 18,
  • impersonate someone, deceive viewers, or present AI output as real footage of a real event,
  • harass, bully, defame, or threaten anyone,
  • infringe anyone's intellectual property, privacy, or publicity rights.

We may refuse to process an upload, remove generated videos, and suspend or close accounts that break these rules, without refund. We may report illegal content to the relevant authorities.

Your Content

You keep ownership of the photos you upload. You grant us a limited license to process your photos only to generate and deliver your video. You are responsible for how you use and share the videos you generate.

Each time you upload a photo, you confirm that:

  • you own the photo or have the right to use it,
  • every recognizable person in it is 18 or older and has agreed to you uploading it and making an AI video of them, and
  • using it with the Service does not break anyone's privacy, publicity, image, or intellectual property rights, or any law.

You are solely responsible for the photos you upload and the videos made from them. We do not check whether you have permission from the people in your photos.

Indemnification

You agree to defend, indemnify, and hold harmless ZapVid and its operators from any claims, damages, losses, fines, and costs (including reasonable legal fees) that arise from the photos you upload, the videos you generate or share, your breach of these Terms, or your violation of anyone's rights, including claims by people shown in your photos or videos.

AI-Generated Content

Every video the Service makes is generated by artificial intelligence. It is a synthetic edit, not real footage of a real event. When you post a video, label it as AI-generated where the platform asks you to (TikTok, Instagram and YouTube all have AI labels), and do not present it as real footage of the people shown. Do not use the Service to make content that could be mistaken for a real person's actual words or actions in a way that misleads or harms them.

Music and Third-Party Rights

Videos on the Service, including on-site previews, example videos and downloads, do not include the original music. If you add music to your video, for example by choosing a sound from a platform's music library or in an editing app, you are responsible for having the right to use it and for following the rules of the platform you post to and applicable law.

ZapVid is an independent service. Its templates are inspired by trending videos and are not affiliated with, endorsed by, or sponsored by any artist, creator, record label, or production company behind the original trends. All trademarks belong to their respective owners.

Credits, Plans, Payments, and Refunds

Videos are paid for with credits. You can get credits in two ways: one-time credit packs, or a plan billed monthly or yearly. Prices are shown before checkout. Payments are processed by our payment provider and we do not store your full card details. The key billing terms are numbered so you can refer to them.

B1. Credit packs. A credit pack is a one-time payment with no renewal. Pack credits do not expire.

B2. Plans renew automatically. A plan is billed monthly or yearly, as chosen at checkout. It charges the price shown at checkout when you subscribe and again at the start of every billing period, until you cancel. Yearly plans are billed once a year.

B3. Plan credits are added and reset every month. Each month of a plan adds that plan's monthly credits to your account, including on yearly plans, where the credits are added month by month and not all at once. Plan credits are used before pack credits. Plan credits you have not used when the next month's credits are added, or when your plan ends, are removed and do not carry over. Pack credits are never removed.

B4. Cancel anytime. You can cancel from the Credits page in your account (Manage plan) or by emailing contact@zapvid.ai. Cancelling stops future charges. Your plan and its monthly credits stay active until the end of the period you already paid for.

B4a. Changing plans. On a monthly plan you can upgrade to a bigger plan at any time. You pay the difference between the two monthly prices right away, the extra credits are added right away, and your billing date stays the same; from the next billing date you pay the new plan's price. A switch to a smaller plan takes effect on your next billing date, with no refund for the current month. To change a yearly plan, email contact@zapvid.ai.

B5. Failed videos. If a generation fails for a technical reason on our side, the credits used are returned to your account automatically.

B6. Refunds. You can get a full refund of a credit pack, or of any plan payment (monthly, yearly or an upgrade), within 7 days of that payment if none of the credits it added have been used. After 7 days, or once credits from that payment have been used for a delivered video, the payment is not refundable, including the unused months of a yearly plan. A refund removes the credits that payment added.

B7. Results vary. Videos are made by AI video models, which have limits and some randomness. The same photos can give different results each time. This shows most when you add friends or change the scene: a friend may not appear in the video, may only partly resemble their photo, or may be merged with another friend who looks similar. A video that is missing a friend, or that looks different from what you expected, still counts as a delivered video and its credits are not returned.

B8. Rule breaks. Accounts closed for breaking the Acceptable Use rules are not eligible for refunds.

Accounts

You must be at least 18 years old to use the Service. You must provide accurate information when creating an account and keep your login secure. You are responsible for activity under your account.

If you believe a video made with the Service, or anything on this website, infringes your copyright or uses your likeness without permission, email contact@zapvid.ai with: a description of the work or person concerned, the link or details that identify the content, your contact information, and a statement that you are the rights holder or authorized to act for them. We review every request and remove content that breaks these Terms.

Disclaimer and Limitation of Liability

The Service is provided "as is" and "as available". We do not guarantee that it will be uninterrupted or error-free, or that any output will meet your expectations. To the fullest extent permitted by law, our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim.

Changes

We may update these Terms. If we make material changes, we will update the date at the top of this page. Continued use of the Service after a change means you accept the updated Terms.
